Arena Release and Waiver of Liability

Callidora Tribe Inc., d/b/a Callidora Ranch · 3990 Buckhead Road, Madison, Georgia 30650

WARNING: Under Georgia law, an equine activity sponsor or equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of animal activities, pursuant to Chapter 12 of Title 4 of the Official Code of Georgia Annotated.

This release applies to every arena rental, membership, and use of the ranch's arena, trails, and grooming areas by the rider named in the booking ("Rider"). The released parties are Callidora Tribe Inc., Callidora Ranch, and their owners, officers, family members, employees, and agents (together, "the Ranch").

1. Inherent risks

Rider understands that riding and handling horses is dangerous. The inherent risks include a horse's tendency to kick, bite, buck, bolt, or fall; its unpredictable reaction to sounds, sudden movement, unfamiliar objects, people, or other animals; ground and footing conditions; collisions with other horses, riders, or objects; and the rider's own failure to maintain control or act within their ability. Rider voluntarily accepts these risks.

2. Shared arena

The arena is shared. Other riders and horses may be present during Rider's hour, and Rider accepts the added risk of riding with others.

3. Release

To the fullest extent Georgia law allows, Rider releases, waives, and agrees not to sue the Ranch for any injury, death, or loss to Rider, Rider's horse, or Rider's property arising from use of the ranch, including claims based on the Ranch's ordinary negligence. This release does not cover gross negligence or willful misconduct.

4. Indemnity

Rider will defend and hold the Ranch harmless from claims brought by Rider's guests, by anyone claiming through Rider, or arising from Rider's horse, including damage the horse causes to ranch property.

5. Rider's responsibilities

  1. Bring only horses Rider owns or controls, with a current negative Coggins test on hand.
  2. Ride within Rider's ability and follow the posted arena rules and the Arena Rental Terms.
  3. Wear an ASTM/SEI-certified helmet. The Ranch strongly recommends this for all riders.

6. Medical care

The Ranch may arrange emergency medical or veterinary care for Rider or Rider's horse if Rider can't. Rider is responsible for the cost.

7. Riders under 18

If the Rider is under 18, the parent or legal guardian who makes the booking accepts this release on the minor's behalf and on their own behalf, and agrees to the indemnity in Section 4.

8. General

Georgia law governs this release, and any dispute will be heard in Morgan County, Georgia. If any part is found unenforceable, the rest remains in effect. This release covers every visit until Rider's booking or membership ends. For members, this release stays in effect for as long as the membership is active. For students of an approved riding instructor, it stays in effect for as long as the Rider remains that instructor's student. Members must tell the Ranch and update their information if anything on file changes, such as their horse, Coggins test, phone number, or emergency contact.

9. Electronic acceptance

Checking the release box and typing a full name online after booking or joining is a signature on this release, by Rider or, for a Rider under 18, by the parent or legal guardian. The Ranch keeps a record of the signer's name, email, the time and internet address of signing, and the version of this release that was signed.
